Republic Act 9257 provides additional benefits and privileges to senior citizens coming from the government and the private establishments, amending for the purpose Republic Act 7432, “An Act to Maximize the Contribution of Senior Citizens to Nation Building.”

ADDITIONAL BENEFITS AND PRIVILEGES FOR SENIOR CITIZENS


  1. Twenty Percent (20%) Discounts on Goods and Services

    Establishments - like hotels, restaurants; recreation centers; drugstores; hospital pharmacies medical and optical clinics and similar establishments dispensing medicines and medical rehabilitative/assistive devices; and funeral parlors and;
    Public Transportation

    • Land - in public railways, including LRT, MRT, PNR, Skyways, buses, (PUB), jeepneys (PUJ), taxi and shuttle services (AUV);
    • Air and Sea - in fare for domestic air, and sea travel based on the actual fare, including the promotional fare, advance booking and similar discounted fare for the exclusive use and enjoyment of Senior Citizens;

    • Medical and Dental Services in Private Facilities - including diagnostic laboratory fees such as but not limited to x-ray, computerized tomography scans and blood tests, including professional fees of attending doctors in all private hospitals and medical facilities; and

    • Admission fees - charged by theaters, cinema houses and concert halls, circuses, carnivals and other similar places of culture, leisure and amusement;
  2. Special Discounts in Special Programs - for senior citizens on purchase of basic necessities and prime commodities.

  3. Free Medical and Dental Services in Government Facilities - including diagnostic and laboratory fees such as, but not limited to x-rays, computerized tomography scans and blood tests in all government facilities subject to guidelines issued by DOH.

  4. Exemption
    Individual Income Tax -provided that the annual taxable income of a senior citizen from all sources does not exceed the poverty level.
    Training Fees - for socio-economic programs conducted by private and government agencies.

  5. Educational Privileges - Educational assistance to qualified senior citizens to pursue post secondary, post tertiary, vocational or technical education in both public and private schools through the provision of scholarships, grants, financial aid, subsidies and other incentives including support for books, learning materials and uniform allowance to the extent feasible.

  6. Benefits and Privileges for Retirees - Grant of continuance of the same benefits and privileges given by the Government Service Insurance System (GSIS), and Social Security System (SSS) and PAG-IBIG. Retirement benefits of retirees from both the government and the private sector shall be responsive and sustainable, and shall be upgraded to be at par with the current scale enjoyed by those in active service.

  7. Express Lane Privileges - in all private, commercial and government establishments; in the absence thereof, priority shall be given to them.

    PARTICIPATING AGENCIES:
    The participating agencies include:

    • Department of Social Welfare and Development (DSWD)
    • Department of Health (DOH)
    • Department of Labor and Employment (DOLE)
    • Department of Education (DepEd)
    • Department of Transportation and Communication (DOTC)
    • Department of Justice (DOJ)
    • Department of the Interior and Local Government (DILG)
    • Department of Trade and Industry (DTI)
    • Department of Finance (DOF), Commission on Higher Education (CHED)
    • Technical Education and Skills Development Authority (TESDA)
    • National Economic and Development Authority (NEDA)
    • Housing and Urban Development Coordinating Council (HUDCC)
    • Five non-government organizations or people’s organizations for senior citizens, duly accredited by DSWD are also involved.

DOCUMENTS NEEDED TO AVAIL OF BENEFITS
A senior citizen can present any of the following:

  1. Identification card - issued by the city or municipal mayor / Office of Senior Citizens Affairs (OSCA) or of the barangay captain of the place where the senior citizen resides.
  2. Passport
  3. Other documents - that establish the senior citizen as a citizen of the Republic and who is at least 60 years old.

DISCOUNTS AS TAX DEDUCTION OF ESTABLISHMENTS
The discounts granted to senior citizens by various establishments; the discounts on medical and dental services in private facilities; and air, sea and land transportation can be converted to tax deduction based on the net cost of the goods sold or services rendered.

PENALTIES AND SANCTIONS
Persons who violate the provisions of this Act will be fined P50,000 - P100,00 and imprisonment of six months to two years for first violation. A fine of P100,000 - P200,000 and imprisonment of two years to six years for subsequent violations.

Any person who abuses the privileges shall be punished with a fine of not less than P5,000 but not more than P50,000 and imprisonment of not less than six months.

If the offender is an alien or a foreigner, he shall be deported immediately after service of sentence without further deportation proceedings.

Corporations, organizations or any similar entities which violate the provisions of the Act would cost them the cancellation or revocation of their business permit, permit to operate, franchise and other similar privileges granted to any business entities.

OTHER PROVISIONS OF THE ACT

  1. Establishment of Various Inter-Agency Monitoring and Coordinating Mechanism - at the national and regional level to undertake the various functions for the interest of senior citizens.

  2. Discount for Utilities - At least 50percent discount for the consumption of electricity, water and telephone shall be granted to senior citizens center and residential care / group homes that are non-stock, non-profit domestic corporation organized and operated exclusively for the purpose of promoting the well-being of abandoned, neglected, unattached or homeless senior citizens.

  3. Budget - The funding necessary to implement the programs and services required by the Act and these regulations shall be included in the annual appropriations of the agencies and Local Government Units (LGUs).

  4. Selection of Head of the Office of Senior Citizens Affairs (OSCA) - The organization of senior citizens on the city and municipal level shall recommend nominees for the head of OSCA to be submitted to the Sangguniang Panlungsod or Sangguniang Bayan, which shall choose three nominees to be forwarded to the Office of the Mayor.
